Acceptable Use & Best Practices for Messaging

At Carolina Digital Phone, we strictly adhere to the rules and best practices around SMS/MMS messaging to mobile subscribers. Please review the following rules and guidelines in their entirety to make sure you understand what is allowed on our network. Acceptable Use

The following criteria must be strictly adhered to for any message traffic on the Carolina Digital Phone network. If you are a reseller or aggregator of messaging traffic, it is your responsibility to ensure your customers adhere to these rules if the traffic will be sent to Carolina Digital Phone and our upstream carriers. Any violations of these acceptable use terms will result in immediate suspension and/or account termination.

1. Forbidden content.

Any message content that falls into one of the following categories is strictly prohibited on the Carolina Digital Phone network:

S – Sex (Pornography, human/sex trafficking, prostitution)

H – Hate (including but not limited to abuse, discrimination, violence, harassment)

A – Alcohol

F – Firearms (including ammunition)

T – Tobacco (including vaping, Cannabis, & CBD products)

Additionally, these categories are also prohibited:

  • Payday loans
  • Loan/Debt Consolidation
  • Debt Forgiveness
  • Debt Collection
  • Credit Repair
  • Tax Refund Loans
  • Gambling/Casino
  • Multi-level Marketing/Pyramid Schemes
  • Malware, viruses, or other malicious content

 

2. Opt-in.

For all commercial messaging content, you must have documentation (proof) of prior written consent or “opt-in” from the subscribers you are messaging. Note: Carolina Digital Phone reserves the right to request proof of opt-in at any time.

3. Opt Out.

It is your responsibility to manage “opt-out” requests to ensure that they get processed properly and that the subscriber’s mobile number is immediately taken out of your contact list to prevent further messages being sent to their number. You must provide reasonable mechanisms for the subscriber to opt-out meaning they should be able to respond with any variation of “Stop” or “Opt out.”

4. Do Not Call (DNC) registry.

It is your responsibility to verify the mobile subscribers you are messaging are not listed on the national and individual state DNC databases. Carolina Digital Phone reserves the right to randomly inspect your message traffic to verify your subscriber’s mobile numbers are not on any of the DNC list(s). Any number found on the DNC list during an active campaign will incur a $5 surcharge.

5. Misleading/Malicious weblinks or URL’s

URL’s that direct or redirect to websites that are fraudulent, phish for consumer data (social security numbers and credit card information), or bait subscribers into completing forms with the false premise they will win a prize. Also, weblinks/URL’s that trigger software downloads the subscriber was not made aware of.

6. Misrepresenting your identity

Misrepresenting your identity as another business, government agency, or as another individual.

7. Copywrite Infringement

Sending messages that include trademarked or copyrighted material that has not been licensed for your use.

8. Sending multiple messages in succession

Sending multiple messages in succession with a mobile subscriber that is not engaged in 2-way communication with you.

9. Forbidden hours for messaging.

Sending messages between the hours of 8:00 AM and 9:00 PM local time to the mobile subscriber you are messaging.
